- (g) “Website” means canellis.com.au and any related pages or online channels we operate.
3. Scope of Services
3.1 We offer property management and co-hosting Services for short-term rentals, which may include:
- (a) Advising on property set-up, pricing and listing strategy
- (b) Creating and managing listings across OTAs and other platforms
- (c) Managing calendars, rates and availability (including dynamic pricing via third-party tools)
- (d) Handling guest enquiries and communications before, during and after a stay
- (e) Coordinating cleaners, tradespeople and maintenance as agreed
- (f) Monitoring reviews and recommending improvements
- (g) Providing performance updates and income summaries to Owners.
3.2 The specific Services provided, and the applicable fees, will be set out in our management agreement, proposal or package agreed with each Owner.
3.3 If there is any inconsistency between these Terms and a signed management agreement with you, the management agreement will usually prevail to the extent of that inconsistency.
4. Relationship with OTAs
4.1 In most cases:
- (a) The accommodation contract is between the Owner and the Guest, governed by the OTA’s terms and conditions; and
- (b) We act as the Owner’s manager or co-host, using OTAs and other platforms to facilitate bookings and manage the Property.
4.2 We do not operate or control OTAs and are not responsible for:
- (a) Changes to OTA policies, fees or commission structures
- (b) Platform outages, technical issues or errors
- (c) Guest reviews, content or actions on those platforms.
4.3 Guests and Owners must comply with the terms and conditions of each OTA used.
5. Bookings, payments and trust account
5.1 Bookings are generally processed through OTAs or our approved booking channels and are subject to the relevant platform’s booking terms and cancellation policies.
5.2 Rental payments and other amounts collected from Guests may be received through the trust account operated by Jacquelynn Smith Pty Ltd, or through other compliant trust or payment arrangements as advised from time to time, in accordance with applicable real estate and trust accounting regulations.
5.3 Unless otherwise agreed in writing:
- (a) Our management fees and agreed charges (for example, cleaning, linen, consumables and agreed maintenance) may be deducted from booking proceeds before payouts to the Owner
- (b) Net amounts are then paid to the Owner’s nominated bank account within a reasonable period after funds are cleared from OTAs or payment providers
- (c) We may set off any amounts you owe us (for example, unpaid fees or approved expenses) against future payouts.
5.4 Details of fee percentages, charges and payment timing will be set out in your management agreement, proposal or package.
6. Owner responsibilities and compliance
6.1 As an Owner, you are legally responsible for ensuring that your Property can lawfully be used for short-term rental accommodation, including complying with:
- (a) NSW short-term rental accommodation laws and the STRA Code of Conduct
- (b) Local council planning rules, zoning and approvals; and
- (c) Any strata, building or community scheme by-laws.
6.2 You must ensure the Property is safe and compliant, including (as applicable):

- (b) Public liability insurance sufficient for short-term guests.
6.4 You must provide accurate and truthful information about the Property, including features, condition, restrictions and any material risks or limitations, and promptly inform us of changes.
6.5 We may assist with guidance and coordination, but final legal responsibility for compliance rests with the Owner unless otherwise required by law.
7. Guest responsibilities (high-level)
7.1 Guests must:
- (a) Comply with all house rules and OTA/platform rules

7.2 Breach of these requirements may result in cancellation, eviction from the Property and/or reporting to OTAs or relevant authorities, in accordance with platform rules and applicable laws.
8. Cancellations and changes
8.1 Guest cancellations and associated refunds are primarily governed by the OTA’s cancellation policy chosen for the listing (for example, flexible, moderate or strict). We do not control OTA refund rules and may be required to follow the platform’s decision.
8.2 If an Owner requests cancellation of confirmed bookings or withdraws a Property from short-term rental:
- (a) Additional costs or penalties may apply under OTA rules; and
- (b) The Owner may be responsible for such costs, including any goodwill discounts, relocation costs or penalties charged by OTAs.
